Website Terms of Service

Elevated Students, a DBA of Elevated Environments LLC · Version 1.0 · Effective Date: July 27, 2026

These Terms of Service ("Terms") govern your use of the Elevated Students website at elevatedstudents.ai (the "Website"). By accessing or using the Website, you agree to these Terms. These Terms apply to the Website only. If you create a parent or student account and use the Elevated Students platform, your use of the platform is governed by the separate Elevated Students Service Platform Terms and Conditions, available at elevatedstudents.ai/service-terms-and-conditions.

1. About Us

Elevated Students is a DBA (doing-business-as) name of Elevated Environments LLC ("Elevated Students," "Elevated," "we," "us," or "our"), a Delaware limited liability company. Elevated Students offers an AI-enabled family coaching and student development service that helps parents and their teens understand how a teen is developing and build the skills and habits that matter most during the adolescent years, including college and future planning and college application support. The Website is an informational and marketing resource through which prospective and current families can learn about our service, create an account, and access support resources.

Elevated Students provides guidance and developmental support. It does not provide medical, mental health, clinical, psychological, therapeutic, educational, or other licensed professional services through the Website.

2. Acceptance of Terms

By accessing or using the Website, you agree to these Terms. The Website is an informational site that anyone may browse, including minors under 18. If you create an account or complete a transaction on the Website, you represent that you are at least 18 years of age, or that a parent or guardian who agrees to these Terms is acting together with you. Students who use the Elevated Students service do so under the separate Service Platform Terms and Conditions and the parent-authorization process described there, not under these Website Terms. If you are accessing the Website on behalf of another person or a household, you represent that you have authority to do so.

We may update these Terms from time to time. We will post the updated version on the Website with a revised effective date. Your continued use of the Website after the effective date of any update constitutes your acceptance of the revised Terms.

3. Use of the Website

3.1 Permitted Use

You may access and use the Website for lawful purposes consistent with these Terms. You may view, download, and print Website content for your own personal or family information, provided you do not remove any copyright or proprietary notices.

3.2 Prohibited Uses

You may not use the Website to:

  • Scrape, harvest, or systematically extract data or content from the Website by automated means;
  • Attempt to probe, scan, or test the security of the Website or its infrastructure;
  • Introduce malware, viruses, or other harmful code;
  • Impersonate Elevated Students or any other person or entity;

Nothing on this Website grants any license or right to use any Elevated Students or Elevated Environments trademark, trade name, or logo without our prior written consent.

You retain ownership of any content you submit to us through the Website (such as a contact or inquiry form). By submitting content, you grant Elevated a limited, non-exclusive license to use it for the purpose for which it was submitted.

Elevated Students outputs are data-derived analytical indicators designed to support family and coaching decisions, not clinical assessments, psychological evaluations, diagnoses, or treatment. Elevated Students does not provide mental health treatment, family therapy, or clinical mindfulness training. Where our service surfaces signals that suggest a family may benefit from a licensed professional, we aim to say so plainly so the family can seek the right help from the right person. If your child is in crisis or you have concerns about their safety, contact a qualified professional or emergency services immediately.

Blog posts, articles, and other editorial content published on the Website reflect the views of the author and are provided for general informational purposes only. References to outcomes, statistics, trends, or third-party research are provided for illustrative purposes and may change over time.

Elevated does not control, endorse, or take responsibility for the content, privacy practices, or availability of any third-party site. ELEVATED MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE WEBSITE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. ELEVATED DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

We make reasonable efforts to keep the Website accurate and up to date, but we do not guarantee the accuracy, completeness, or timeliness of any information on the Website.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ELEVATED ENVIRONMENTS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE WEBSITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you in connection with your use of the Website, for any and all claims, is limited to the greater of the total fees, if any, you paid to Elevated in the twelve (12) months preceding the claim, or five hundred dollars ($500.00). This cap does not apply to liability for Elevated's fraud, gross negligence, or willful misconduct, or to any liability that cannot be limited or waived under applicable law, including statutory damages available to a consumer under a data-breach right of action (such as the damages provided under California Civil Code section 1798.150).

Some jurisdictions do not allow limitations on implied warranties or exclusions of certain damages. In those jurisdictions, our liability is limited to the fullest extent permitted by applicable law.

10. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflicts of law principles. Nothing in these Terms deprives you of the protection of any mandatory consumer-protection provisions of the law of the state where you reside that cannot be waived by agreement. Any dispute arising under these Terms that is not resolved informally will be submitted to the exclusive jurisdiction of the state and federal courts located in Salt Lake County, Utah.

11. Assignment

Elevated may assign these Terms, in whole or in part, to a successor entity in connection with a merger, acquisition, corporate restructuring, or sale of all or substantially all of its assets or business, without prior notice. You may not assign these Terms or any rights under them without our prior written consent.

12. Miscellaneous

Severability. If any provision of these Terms is found unenforceable, the remaining provisions continue in full force.

No Waiver. Failure to enforce any provision does not constitute a waiver of the right to enforce it in the future.

Entire Agreement. These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Elevated with respect to your use of the Website. If you create an account, your use of the platform is governed by the separate Elevated Students Service Platform Terms and Conditions.

Force Majeure. Elevated is not liable for failures or delays caused by events beyond its reasonable control, including natural disasters, government actions, or internet infrastructure failures.
